TERMS OF USE

This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of www.muscleblessing.com website and Muscle Blessing mobile application (hereinafter referred to as "Platform").

The Platform is owned by Muscle Blessing, a company incorporated under the Companies Act, 1956 with its registered office at 123 Fitness Street, Mumbai, Maharashtra 400001, India (hereinafter referred to as "Muscle Blessing" or "we" or "us" or "our").

Your use of the Platform and services and tools are governed by the following terms and conditions ("Terms of Use") as applicable to the Platform including the applicable policies which are incorporated herein by way of reference. By mere use of the Platform, You shall be contracting with Muscle Blessing and these terms and conditions including the policies constitute Your binding obligations, with Muscle Blessing.

For the purpose of these Terms of Use, wherever the context so requires "You" or "User" shall mean any natural or legal person who has agreed to become a buyer on the Platform by providing data while registering on the Platform as Registered User. The term "Muscle Blessing", "We", "Us", "Our" shall mean Muscle Blessing and its affiliates.

When You use any of the services provided by Us through the Platform, including but not limited to, product reviews, seller reviews, You will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into this Terms of Use and shall be considered as part and parcel of this Terms of Use.

We reserve the right, at Our sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time without any prior written notice to You. You shall ensure to review these Terms of Use periodically for updates/changes. Your continued use of the Platform following the posting of changes will mean that You accept and agree to the revisions. As long as You comply with these Terms of Use, We grant You a personal, non-exclusive, non-transferable, limited privilege to enter and use the Platform.

Membership Eligibility

Use of the Platform is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. are not eligible to use the Platform. If You are a minor i.e. under the age of 18 years, You shall not register as a User of the Platform and shall not transact on or use the Platform. As a minor if You wish to use or transact on the Platform, such use or transaction may be made by Your legal guardian or parents on the Platform. Muscle Blessing reserves the right to terminate Your membership and/or refuse to provide You with access to the Platform if it is brought to Muscle Blessing's notice or if it is discovered that You are under the age of 18 years.

Your Account and Registration Obligations

If You use the Platform, You shall be responsible for maintaining the confidentiality of Your Display Name and Password and You shall be responsible for all activities that occur under Your Display Name and Password. You agree that if You provide any information that is untrue, inaccurate, not current or incomplete or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the this Terms of Use, We shall have the right to indefinitely suspend or terminate or block access of Your membership on the Platform and refuse to provide You with access to the Platform.

Your mobile phone number and/or e-mail address is treated as Your primary identifier on the Platform. It is Your responsibility to ensure that Your mobile phone number and your email address is up to date on the Platform at all times. You agree to notify Us promptly if Your mobile phone number or e-mail address changes by updating the same on the Platform through a onetime password verification.

You agree that Muscle Blessing shall not be liable or responsible for the activities or consequences of use or misuse of any information that occurs under Your Account in cases, including, where You have failed to update Your revised mobile phone number and/or e-mail address on the Platform.

Communications

When You use the Platform or send emails or other data, information or communication to us, You agree and understand that You are communicating with Us through electronic records and You consent to receive communications via electronic records from Us periodically and as and when required. We may communicate with you by email or by such other mode of communication, electronic or otherwise.

Platform for Transaction and Communication

The Platform is a platform that Users utilize to meet and interact with one another and Muscle Blessing for their transactions. Muscle Blessing is not and cannot be a party to or control in any manner any transaction between the Platform's Users. All commercial/contractual terms are offered by and agreed to between Buyers and Muscle Blessing alone. The commercial/contractual terms include without limitation price, shipping costs, payment methods, payment terms, date, period and mode of delivery, warranties related to products and services and after sales services related to products and services.

Use of the Platform

You agree, undertake and confirm that Your use of the Platform shall be strictly governed by the following binding principles:

You shall not host, display, upload, modify, publish, transmit, update or share any information which belongs to another person and to which You do not have any right; is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libelous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever; or unlawfully threatening or unlawfully harassing including but not limited to "indecent representation of women" within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986; is misleading in any way; is patently offensive to the online community, such as sexually explicit content, or content that promotes obscenity, pedophilia, racism, bigotry, hatred or physical harm of any kind against any group or individual.

You shall not use any "deep-link", "page-scrape", "robot", "spider" or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Platform or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Platform or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Platform. We reserve Our right to bar any such activity.

Contents Posted on Platform

All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music and artwork (collectively, "Content"), is a third party user generated content and Muscle Blessing has no control over such third party user generated content as Muscle Blessing is merely an intermediary for the purposes of this Terms of Use.

Except as expressly provided in these Terms of Use, no part of the Platform and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including "mirroring") to any other computer, server, Platform or other medium for publication or distribution or for any commercial enterprise, without Muscle Blessing's express prior written consent.

Disclaimer of Warranties and Liability

This Platform, all the materials and products (including but not limited to software) and services, included on or otherwise made available to You through this Platform are provided on "as is" and "as available" basis without any representation or warranties, express or implied except otherwise specified in writing. Without prejudice to the forgoing paragraph, Muscle Blessing does not warrant that this Platform; information, Content, materials, products (including software) or services included on or otherwise made available to You through the Platform; their servers; or electronic communication sent from Us are free of viruses or other harmful components.

Muscle Blessing will not be liable to You for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with use of, or inability to use, the Platform or use of or reliance on any Content displayed on the Platform.

Product Description

Muscle Blessing does not warrant that Product description or other content on the Platform is accurate, complete, reliable, current, or error-free and assumes no liability in this regard. All supplement and nutritional products are sold strictly in accordance with their manufacturer's instructions. Users are advised to read all product labels, warnings, and directions before using or consuming any product. Results may vary and are not guaranteed. Supplements are not intended to diagnose, treat, cure, or prevent any disease. Consult your healthcare provider before starting any supplement regimen, especially if you have pre-existing medical conditions or are taking medications.

Pricing

Muscle Blessing strives to provide accurate pricing information. However, errors may occur. In the event a product is listed at an incorrect price or with incorrect information due to an error, Muscle Blessing shall have the right, at Our sole discretion, to refuse or cancel any orders placed for that product, unless the product has already been dispatched. Unless the product ordered by You has been dispatched, Your offer will not be deemed accepted and Muscle Blessing will have the right to modify the price of the product and contact You for further instructions using the e-mail address provided by You during the time of registration, or cancel the order and notify You of such cancellation.

Indemnity

You shall indemnify and hold harmless Muscle Blessing, its owner, licensee, affiliates, subsidiaries, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys' fees, made by any third party or penalty imposed due to or arising out of Your breach of this Terms of Use, privacy Policy and other Policies, or Your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.

Governing Law and Jurisdiction

These Terms of Use and all transactions entered into on or through the Platform and the relationship between You and Muscle Blessing shall be governed in accordance with the laws of India without reference to conflict of laws principles. You agree that all claims, differences and disputes arising under or in connection with or in relation to the Platform, the Terms of Use or any transactions entered into on or through the Platform or the relationship between You and Muscle Blessing shall be subject to the exclusive jurisdiction of the courts at Mumbai, Maharashtra, India and You hereby accede to and accept the jurisdiction of such courts.
